Art. 1 — Oggetto del Servizio
La piattaforma book-my-room.com è di proprietà esclusiva ed è gestita da Trading Intelligence MFG Ltd (Strovolou 77, Strovolos Center, Flat/Office 301, Strovolos, 2018, Nicosia, Cipro — HE 359784 — P.IVA CY10359784L). Il Gestore opera quale intermediario tecnologico. Il contratto di soggiorno per la locazione dell'Unità è concluso direttamente ed esclusivamente tra il Proprietario (Host) e l'Ospite.
Art. 2 — Modalità di Inserimento Assistito e Accettazione Tacita
Nella modalità di inserimento assistito, il Gestore provvede al caricamento dei dati ponendo l'annuncio in stato di verifica. Il Proprietario riceverà una comunicazione contenente un collegamento per l'approvazione. Decorse 48 ore dall'invio senza obiezioni scritte o richieste di modifica, l'annuncio sarà pubblicato e si intenderà tacitamente approvato, con assunzione della responsabilità dei contenuti da parte del Proprietario.
Art. 3 — Criteri di Posizionamento (Ranking)
Gli annunci sono ordinati nei risultati di ricerca in base a: (a) corrispondenza ai criteri di ricerca dell'Ospite; (b) disponibilità effettiva e aggiornamento calendario; (c) completezza dell'annuncio; (d) prezzo. Il pagamento di corrispettivi al Gestore non incide sul posizionamento.
Art. 4 — Flusso Finanziario, Pagamenti e Rimborsi
L'Ospite versa online, al momento della conferma della prenotazione, un acconto pari al 15% dell'importo del soggiorno. Tale acconto costituisce il compenso del Gestore per il servizio reso ed è da questi trattenuto. Per gli annunci di noleggio mezzi, il compenso del Gestore è pari al 5%, con le medesime modalità.
Il saldo del soggiorno è corrisposto dall'Ospite in contanti all'arrivo, in euro o in dollari statunitensi, ed è riscosso dal personale incaricato dal Gestore per conto e nell'interesse del Proprietario.
Le somme spettanti al Proprietario gli sono corrisposte in contanti sul posto, quando il Proprietario si trova o si reca nella località in cui si trova l'Unità. Qualora il Proprietario risieda altrove, egli indica per iscritto la modalità di pagamento che preferisce; le eventuali spese di trasferimento delle somme restano a suo carico.
Ogni pagamento al Proprietario, qualunque sia la forma con cui avviene, è accompagnato da un rendiconto che ne documenta gli importi e il periodo di riferimento.
L'acconto non è rimborsabile in caso di disdetta da parte dell'Ospite e resta acquisito al Gestore a titolo di compenso. Qualora sia il Gestore a rifiutare la richiesta di prenotazione o ad annullare una prenotazione già confermata, l'acconto è restituito integralmente all'Ospite e nessun compenso è dovuto al Gestore.
Art. 5 — Servizi sul Posto e Ripartizione delle Responsabilità
I servizi resi sul posto — accoglienza degli Ospiti, pulizie, lavanderia, assistenza durante il soggiorno, segnalazione e coordinamento delle riparazioni — sono erogati da personale locale coordinato dal Gestore. Il Gestore resta il referente unico del Proprietario per qualunque questione relativa al servizio: il Proprietario non deve rivolgersi ad altri soggetti.
Il Gestore risponde del proprio servizio: pubblicazione e mantenimento dell'annuncio, gestione delle prenotazioni, incasso delle somme, rendicontazione al Proprietario e coordinamento del personale sul posto.
Il Proprietario risponde dell'Unità: della sua conformità alle norme applicabili, della sua idoneità all'uso cui è destinata e di quanto in essa si trova, inclusi arredi, impianti e dotazioni.
Le riparazioni e la manutenzione straordinaria restano a carico del Proprietario. Il personale sul posto le segnala tempestivamente e ne segue l'esecuzione per conto del Proprietario, ma non le esegue.
Art. 6 — Spese e Compensazioni
Solo le spese documentate ed anticipate dal Gestore per conto del Proprietario sono compensate nel rendiconto che accompagna il pagamento. Le spese sostenute direttamente dal Proprietario o dall'Ospite sono registrate ai soli fini contabili.
Art. 7 — Adempimenti Fiscali
Il Gestore può essere tenuto a comunicare alle autorità fiscali competenti i dati identificativi del Proprietario e dell'Unità, nonché i corrispettivi percepiti, secondo la normativa applicabile. Il Proprietario si impegna a fornire i dati richiesti. In caso di mancato conferimento entro 60 giorni dalla richiesta, il Gestore sospende il profilo e blocca i pagamenti.
Art. 8 — Trasparenza dei Proprietari Professionali
I Proprietari che operano in forma professionale accettano che i propri dati identificativi siano pubblicati nell'annuncio, ove richiesto dalla normativa applicabile. La modalità anonima non è disponibile per loro.
Art. 9 — Durata e Recesso
L'accordo ha durata indeterminata. Il recesso non ha effetto sulle prenotazioni già confermate, né pregiudica il diritto del Gestore alle commissioni maturate o gli obblighi di conservazione dei dati previsti dalla normativa applicabile.
Art. 10 — Regolamento P2B e Sospensione
Per le modifiche unilaterali è garantito un preavviso di 15 giorni. La cessazione definitiva dell'account è comunicata con almeno 30 giorni di preavviso, salvo violazioni di legge o inosservanze reiterate.
Art. 11 — Proprietà Intellettuale e Dati (SCC)
È vietato utilizzare marchi o loghi di terzi (es. nomi di resort) senza autorizzazione. L'Host manleva la società da ogni responsabilità. Per l'Host extra-SEE si applicano le Clausole Contrattuali Standard della Commissione Europea, Modulo 1.
Art. 12 — Legge, Foro e Lingua
Regolato dalla legge della Repubblica di Cipro. Foro esclusivo: Tribunale di Nicosia. In caso di discrepanze tra versioni linguistiche, prevale la versione in lingua inglese.
Art. 1 - Object of the Service
The platform book-my-room.com is exclusively owned and operated by Trading Intelligence MFG Ltd (Strovolou 77, Strovolos Center, Flat/Office 301, Strovolos, 2018, Nicosia, Cyprus - HE 359784 - VAT CY10359784L), hereinafter the "Manager". The Manager operates as a technological intermediary. The accommodation contract is concluded directly and exclusively between the Property Owner (Host) and the Guest.
Art. 2 - Assisted Insertion Mode and Tacit Acceptance
In assisted insertion mode, the Manager uploads the data, placing the listing in a verification status. The Owner will receive a digital communication containing a link for approval. If 48 hours elapse from the sending of this communication without the Owner raising written objections or requesting modifications, the listing will be published and deemed tacitly and fully approved. Upon the expiration of this period, the Owner assumes exclusive responsibility for the content, expressly holding the Manager harmless.
Art. 3 - Ranking Criteria
Listings are ordered in search results based on the following main parameters (in descending order): (a) match of the Unit with the Guest's search criteria; (b) actual availability and calendar updates; (c) listing completeness; (d) price. Remuneration paid to the Manager does not affect the ranking.
Art. 4 - Financial Flows, Payments, and Refunds
Upon confirmation of the booking, the Guest pays online a deposit equal to 15% of the stay amount. This deposit constitutes the Manager's fee for the service provided and is retained by the Manager. For vehicle rental listings, the Manager's fee is 5%, on the same terms.
The balance of the stay is paid by the Guest in cash on arrival, in euros or US dollars, and is collected by the staff appointed by the Manager on behalf of and in the interest of the Owner.
Amounts due to the Owner are paid to him in cash on site, when the Owner is in or travels to the locality where the Unit is located. Should the Owner reside elsewhere, he shall state in writing the method of payment he prefers; any costs of transferring the funds remain at his expense.
Every payment to the Owner, whatever form it takes, is accompanied by a statement documenting its amounts and reference period.
The deposit is non-refundable if the Guest cancels and is retained by the Manager as its fee. Should the Manager refuse the booking request or cancel a booking already confirmed, the deposit is refunded in full to the Guest and no fee is due to the Manager.
Art. 5 - On-Site Services and Allocation of Responsibilities
The services provided on site — welcoming Guests, cleaning, laundry, assistance during the stay, reporting and coordinating repairs — are performed by local staff coordinated by the Manager. The Manager remains the Owner's sole point of contact for any matter relating to the service: the Owner need not approach any other party.
The Manager is responsible for its own service: publishing and maintaining the listing, managing bookings, collecting the amounts due, reporting to the Owner, and coordinating the on-site staff.
The Owner is responsible for the Unit: its compliance with applicable regulations, its fitness for the use for which it is intended, and everything it contains, including furnishings, systems, and equipment.
Repairs and extraordinary maintenance remain at the Owner's expense. The on-site staff report them promptly and oversee their execution on the Owner's behalf, but do not carry them out.
Art. 6 - Expenses and Offsets
Only documented expenses advanced by the Manager on behalf of the Owner will be offset and deducted from the amounts due to the latter in the statement accompanying the payment.
Art. 7 - Tax Compliance
The Manager may be required to report to the competent tax authorities the identifying data of the Owner and of the Unit, as well as the amounts received, in accordance with applicable law. The Owner undertakes to provide the data requested. If the data is not provided within 60 days of the request, the Manager suspends the profile and blocks payments.
Art. 8 - Transparency of Professional Owners
Owners acting in a professional capacity accept that their identifying data be published in the listing, where required by applicable law. The anonymous mode is not available to them.
Art. 9 - Term and Termination
This agreement is valid for an indefinite period. Withdrawal does not affect already confirmed bookings, nor does it affect data retention obligations under applicable law or the Manager's right to accrued commissions.
Art. 10 - P2B Regulation and Suspension
A 15-day notice period is guaranteed for unilateral modifications. Permanent account termination is communicated with at least 30 days' notice, unless due to legal violations or repeated breaches.
Art. 11 - Intellectual Property and Data (SCCs)
The use of third-party trademarks without authorization is prohibited (e.g. resort names). The Host holds the Manager harmless from any liability. For Hosts located outside the EEA, the Standard Contractual Clauses of the European Commission, Module 1, apply.
Art. 12 - Applicable Law, Jurisdiction, and Prevailing Language
Governed by the law of the Republic of Cyprus. Exclusive jurisdiction: District Court of Nicosia. In the event of discrepancies between linguistic versions, the English version shall prevail.
